AHRC issues a set of Guidelines for Complying with the positive duty under the Sex Discrimination Act 1984 (Cth).

From 12 December 2023, the Australian Human Rights Commission will have the power to enforce compliance with “positive duty”.  On 28 November 2022, the Anti-Discrimination and Human Rights Legislation (Respect at Work) Bill passed Parliament. A key amendment was the introduction of a positive duty on organisations and businesses to prevent workplace sexual harassment, sex-based harassment, sex discrimination, hostile work environments and victimisation. The positive duty requires organisations and businesses to take reasonable and proportionate measures to eliminate these forms of unlawful conduct, as far as possible.  The Commission has released Guidelines which will be used by the Commission to assess workplace compliance. The Guidelines include practical examples and applications of how organisations can

NEWS: Definitions in modern awards have changed with casuals

As at 27 September 2021 all modern awards including the Passenger Vehicle Transportation Award 2020, are varied, from this date, to include the casual employment definition and the new casual conversion entitlement.To this extent definitions in modern awards, that referred to employees as casuals only and payments to casuals by the hour, are removed, as are previous casual conversion clauses.Employers need to give new casual employees a Casual Employment Information Statement before, or as soon as possible after, they start their new job. NEWS: Sex Discrimination and Fair Work (Respect at Work) Amendment Bill 2021

Legislation was introduced into the Senate on 24 June 2021 which sought to amend the Fair Work Act to ensure that sexual harassment was included as serious misconduct for the purposes of termination of employment. The Bill is relevant to bus and coach industry and will be considered by APTIA’s Workplace Equality Advisory Group (WEAG) to develop an industry position.
